Compensation
Worker’s compensation is designed to aid workers upon the occurrence of a work-related injury or illness. This compensation is found through cash benefits or medical care and allows for employees to be directly insured through the employer rather than out of pocket. This compensation right may be removed if the incident was caused by the employee’s own carelessness, intoxication, or with the intent to injure one’s self or others. Worker’s compensation also allows for post-injury benefits in the cases which the injury prevents from earning the same wage prior to the incident by providing a two-third difference makeup. In addition, a worker’s compensation case starts once the incident has been filed, but not more than 30 days after the occurrence, and a claim is made with the Board on Form Employee Claim (C-3). This claim must be mailed it to the correct Board District Office within two years of the incident occurrence. The claim is further paid for by either the employer or the company’s insurance once the confirmation of accidental injury or illness has been proved. In the event of disputes between employer or insurance, the paid compensation to the injured employee is postponed until a law judge dictates who is in the wrong. However, for the time being, an affected employee may be eligible for disability benefits but will cause the compensation value to be subtracted from the future worker’s compensation offered.
